Metro Solutions Inc, doing business as METRO ("Metro," "Metro Rides", "Metro Motors", "Red Performance", "Machines Enhancing Travel", "Machines Enhancing Travel Routes Optimized", "Metro Electronics (Metronics)", "we," "us," or "our"), operates the www.metrorides.co website, associated mobile applications, and any affiliated services (collectively referred to as the "Service").
This Privacy Policy informs you of our policies regarding the collection, use, storage, and disclosure of your data when you use our Service—and the rights and choices you have regarding that data. By using Metro products or services, you consent to the data practices described in this policy. If you do not agree, do not use the Service.
THIS IS A LEGAL AGREEMENT BETWEEN YOU AND METRO ("METRO") THAT GOVERNS YOUR PARTICIPATION AS A METRO USER. 1. DEFINITIONS
- Service: Refers to all websites, software, hardware (scooters, bikes, accessories), mobile applications (iOS and Android), accessories and other digital products offered by Metro.
- Personal Data: Means information that can identify an individual, either on its own or when combined with other data such as your name, email address, phone number, physical address, IP address, location data, payment credentials, and usage history.
- Usage Data: Automatically collected data related to your interactions with our Service, including app activity, session duration, reboot logs, and diagnostics.
- Cookies: Small data files placed on your device to improve user experience and track user behavior.
- Data Controller: Metro acts as the Data Controller for all personal information collected via our Service.
- Data Processor / Service Provider: Any third party who processes Personal Data on behalf of Metro, including vendors for analytics, cloud storage, CRM, and payment services.
- User (or Data Subject): The individual using the Service and providing data.

Location Data
If you enable GPS-based features, we may collect your real-time device location. This is necessary for scooter tracking, ride analytics, and map functionality. Location data is only gathered during use of the Service, not in the background unless explicitly authorized.

These Terms and Conditions ("Terms") govern the purchase, access, and use of products and services offered by Metro Scooters LLC soon Metro Solutions CO., a Tri-State corporation ("Metro Motors//Rides//Mobility//Electronics", "we," "us," or "our"). These include, but are not limited to, personal mobility vehicles, accessories, mobile applications, software, firmware, connected services, and affiliated support platforms (collectively, the "Products" or "Services").
By using our Products or Services in any capacity, you ("you" or the "User") acknowledge and agree to be bound by these Terms. If you do not accept these Terms, you may not access, own or utilize our Products or Services and you are to stop the use of them immediately.

1. Binding Agreement
By accessing or using any portion of the Metro Motors platform or Products, you affirm that you are at least 18 years of age, possess the legal authority to enter into a binding contract, and consent to be legally bound by the provisions of these Terms.
2. No Warranty or Guarantee of Specific Outcome
METRO, hereinafter referred to as Metro Solutions, Metro Rides and Metro Motors (Performance Division), develops its vehicles and products with a focus on reliability, daily utility, safety, portability and responsible use. However, we do not and cannot guarantee specific outcomes, and no mechanical failure. Nor do we warrant that misuse, user error, or negligent operation will not occur. Accordingly, Metro Scooters LLC disclaims liability for:
- Injury, death, or property damage resulting from any use, negligence, or violation of traffic laws from our products. When using our products you agree to our terms and conditions;
- Unauthorized modifications or alterations of Products;
- Use inconsistent with intended design or safety recommendations, including the failure to wear proper protective equipment.
- Any random mechanical failure that theoretically should not occur in original use. (Original being; unaltered, unmodified, operated responsibly, maintained) Each product has a Standard operating procedure of Quality control. However, some cases are unpredictable and unavoidable. In the event that an unlikely mechanical error occurs randomly during the duration of operation, or stagnation, including and not limited to: bolts coming undone, wheels wobbling or seizing out of control, stuck cruise control, brake system failure, battery/charging, random shutoff, and more. If there is any failure of any form resulting in injury, loss or death, Metro is not held liable.
Use our Products at your own risk and with appropriate discretion. We disclaim liability for any accidents or unnatural occurrences and the damages that correspond with them.
Metro holds the right to deny claims that are proven to be fraudulent, or misuse behavior.
If you do not wish to agree to these terms, immediately and responsibly donate, return or discard your Metro product.
3. Release of Liability and Indemnification
To the maximum extent permitted by applicable law, you agree to release, indemnify, defend, and hold harmless Metro Motors and its officers, directors, employees, affiliates, suppliers, agents, contractors, and any other employees from and against any claims, demands, actions, losses, liabilities, or expenses—whether known or unknown—arising out of or in any way related to:
- Your use or misuse of any Metro Product;
- Physical injury or property damage arising in connection with use;
- Third-party interactions occurring while using our Services;
- Weather conditions, environmental hazards, or terrain challenges.
This waiver includes all theories of liability, including negligence, strict liability, and product liability.

5. User Obligations
As a condition of your use, you agree to:
- Comply with all local, state, and federal laws applicable to vehicle operation;
- Wear all recommended safety gear, including our helmets and our reflective gear;
- Perform a pre-ride inspection of your vehicle;
- Immediately cease operation upon detecting any performance or safety issue;
- Refrain from allowing unauthorized users to access your account or any Metro Motors Product.
6. Intellectual Property and Ownership Rights
All Products, software, design elements, user interfaces, firmware, documentation, trademarks, trade dress, and associated intellectual property are the sole property of Metro Motors and are protected under United States and international intellectual property laws.
You may not:
- Copy, reverse-engineer, decompile, or create derivative works of any Metro Product;
- Sell, sublicense, lease, or distribute any Product without written consent;
- Use Metro Solutions branding, trademarks, or proprietary materials without our express authorization.
7. Software Licensing
The Metro+ mobile application and any associated firmware or software are provided to you under a limited, non-exclusive, revocable, non-transferable license strictly for personal use in accordance with these Terms. This license does not convey any ownership rights.
8. Limitation of Liability
To the fullest extent permitted by law, Metro shall not be liable for any incidental, indirect, special, punitive, or consequential damages.
Including, but not limited to, lost profits, loss of data, or business interruption arising from the use or inability to use our Products or Services.
Metro's maximum aggregate liability to you shall not exceed the amount you paid for the Product or Service directly from our own website, retailers or store fronts, that is the subject of the claim. Any price mark up from independent sellers is not included in the aggregate.
9. Termination of Access
Metro reserves the right to suspend, limit, or terminate your access to any Product or Service at its sole discretion, without notice, if you breach these Terms or engage in unlawful conduct. All disclaimers, releases, and limitations of liability shall survive termination.
10. Governing Law and Venue
These Terms shall be governed by, and construed in accordance with, the laws of the State of New Jersey, without regard to its conflict-of-law provisions. You agree that all legal proceedings arising out of these Terms shall be initiated exclusively in the state or federal courts located in New Jersey County, and you expressly consent to the jurisdiction and venue of such courts.
11. Modifications to Terms
Metro Motors may amend these Terms at any time by posting a revised version on our website. Your continued use following such amendments constitutes your acceptance. The latest version will always be available at: www.metroamerica.com/terms
